General Terms and Conditions of AirportAcademy

1 General, scope of application

Flughafen München GmbH (FMG, hereinafter also referred to as "AirportAcademy" or "we"), legally represented by the respective Managing Directors, Nordallee 25, 85356 Munich, offers its Group employees as well as external companies and their employees a broad programme of courses, seminars, training or professional development under the name "AirportAcademy" as a certified training provider and conducts the events on site and/or online (hereinafter referred to as "Services"). In particular, this also includes training that is mandatory for participation in airport operations (e.g. apron driving licence, aviation security training).

The following General Terms and Conditions of AirportAcademy apply to the booking and realisation of all services offered. In addition, further AirportAcademy terms and conditions of business and/or participation may apply to certain services, which can be accessed on the AirportAcademy website https://www.munich-airport.de/academy/de. The participant's general terms and conditions do not apply, even if the AirportAcademy is aware of them and does not expressly object to them.

2 Registration, invoicing and terms of payment

2.1 Registration

Registration for a service offered takes place online via an online learning platform provided by the AirportAcademy or in text form by accepting an offer sent to you. With free registration via the online learning platform, the participant/user receives his/her personal user account.

Registration is binding and places are booked on a first-come, first-served basis. As soon as the payment process has been initiated, the participant will receive a confirmation e-mail including all relevant information about the booked service. After participating in the service, the participant will receive the invoice in a further e-mail.

Upon receipt of the confirmation e-mail by the participant, the booking of the service also becomes binding for the AirportAcademy, subject to changes or cancellation in accordance with the provisions under no. 4.

2.2 Invoicing and terms of payment

The prices stated on the AirportAcademy online learning platform at the time of booking apply. Theapplicable fees are shown transparently when booking. All fees quoted are net plus statutory VAT. The AirportAcademy will invoice the fee with VAT to the address given. AirportAcademy invoices must be paid within ten days of the invoice date. The invoice amount is to be transferred without deduction to one of the specified accounts. The AirportAcademy reserves the right to invoice the fee in full or in part in advance.

3 Conclusion of contract, provision of services

AirportAcademy's offers are subject to change and non-binding, unless their binding nature has been expressly agreed in text form. This also applies to the price information.

The AirportAcademy may also use third parties to provide services.

4 Delivery of events

4.1 Right of alteration

The AirportAcademy reserves the right to provide services that deviate from those described, insofar as this does not significantly impair the nature or quality of the service, in particular to use another suitable speaker instead of a named speaker.

4.2 Postponement or cancellation by the AirportAcademy

4.2.1 Individual written offer

If the AirportAcademy has to change a confirmed date or period for a service for unforeseeable reasons, the AirportAcademy can offer the customer participation on the changed date or in the changed period or cancel the service. If a change offer from the AirportAcademy is not confirmed by the customer in text form within 14 calendar days, the service is considered cancelled. In this case, the AirportAcademy will reimburse the customer for any pre-paid fees without delay; any further claims are excluded.

4.2.2 Online booking

If the AirportAcademy has to change a confirmed date or period for a service, the service will be cancelled by the AirportAcademy. The participant is informed of this and must find and book a new appointment on the online platform.

In the event of cancellation by the AirportAcademy, any fees paid in advance will be refunded to the participant without delay; any further claims are excluded. 

4.3 Cancellation by the customer/participant

4.3.1 Individual written offer

Cancellation of services already booked is not possible. In individual cases, a cancellation request must be issued in text form to the responsible contact at the AirportAcademy, stating the specific circumstances. Cancellation up to 21 calendar days before the start of the service is free of charge. For withdrawals up to 14 calendar days before the service, we charge 50% of the participation fee as cancellation costs. If the withdrawal is made fewer than 14 calendar days before the start of the service, the full participation fee will be charged as a cancellation fee. Cancellation fees are to be paid by the participant by invoice.

The date of receipt of the written cancellation by the AirportAcademy is decisive. If the cancellation is made by an individual participant, he/she may nominate a replacement participant in writing.

4.3.2 Online booking

For services with registration via an online tool, withdrawals or rebookings must be made via the personal profile on the online platform, taking into account the cancellation conditions. Withdrawals up to 21 calendar days before the start of the service will not incur any cancellation costs. For withdrawals up to 14 calendar days before the service, we charge 50% of the participation fee as cancellation costs. If the cancellation is made less than 14 calendar days before the start of the service, the full participation fee will be charged as a cancellation fee.

If the cancellation is made by an individual participant, he/she may nominate a replacement participant.

4.3.3 Web-based training

As soon as a WBT session has been booked, the fee will be invoiced to the participant. Cancellations are excluded for this service.

4.4 Use of e-learning programmes

Each participant receives personalised access from the AirportAcademy. The use of digital learning options is limited to this participant and to a specific period of time. The disclosure of access data to third parties is not permitted.

On successful completion of an online course with a "certificate", the certificate is available to the participant to download free of charge for the entire period of validity.

5 Liability

Unless otherwise stated in these GTC, including the following provisions, the AirportAcademy shall be liable for breaches of duty in accordance with the statutory provisions.

The AirportAcademy is liable for damages, irrespective of the legal grounds, within the scope of fault-based liability in cases of intent and gross negligence. In the event of simple negligence, the Academy shall only be liable, subject to a less stringent standard of liability in accordance with the statutory provisions (e.g. for due diligence in its own affairs), (i) for damages resulting from injury to life, limb or health, (ii) for damages resulting from significant breach of a material contractual obligation (obligation on which proper execution of the contract depends and on compliance with which the contractual partner regularly relies and may rely); in the latter case, however, the Academy's liability shall be limited to compensation for the damage foreseeable and typically occurring at the time of conclusion of the contract.

The limitation of liability also applies to breaches of duty by or on behalf of persons whose fault the AirportAcademy is legally responsible for, as well as any personal liability of bodies, experts and other employees of the Academy. It does not apply if the AirportAcademy or the aforementioned persons have fraudulently concealed a defect or in the case of claims arising from a guarantee of quality or for claims under the Product Liability Act.

The participant must immediately notify the AirportAcademy in text form of any damages for which the Academy is liable.

The AirportAcademy is not liable for any disadvantages or damages that may arise from a pre-announced or technically caused failure of the Learning Online Platform (e.g. maintenance work).

The participant/user is liable for all consequences and disadvantages incurred by the AirportAcademy or third parties due to the improper or illegal use of the service or due to the user's failure to comply with his/her contractual obligations. If there is suspicion of misuse or material breach of contract, the provider reserves the right to investigate these events, to take appropriate precautions and, if there is reasonable suspicion, to block the user's access to the content until the suspicion has been cleared up by the user and/or, in the case of particularly serious breaches, to terminate the contractual relationship without notice. This would result in the immediate blocking of the user account. The block will be lifted as soon as the user clears up the existing suspicion.

The AirportAcademy website contains links to third-party websites. The AirportAcademy provides these links as an additional service or courtesy and has no influence on the content of the linked third-party websites. The AirportAcademy is not liable for the accuracy, currency, content and completeness of the information provided. Likewise, the AirportAcademy is not liable for the functional reliability of the pages or the data, services or work offered thereon.

6 Retention of title and use of teaching material

The AirportAcademy retains unrestricted ownership of all deliveries of teaching materials until the customer has fulfilled all payment obligations in full.

7 Photographs and video recording

Photo logs taken during the course will only be made available to the participants of the course in the learning environment. Participants who do not agree to themselves being recorded or the photo log being uploaded to the learning environment should contact the trainer. Photographs and videos of participants may be taken during some of the services. These recordings may be used for promotional purposes of the AirportAcademy. In this case, the AirportAcademy will obtain the consent of the participants.

8 Copyright, confidentiality, data protection

Documents, software and other media provided to participants for the purposes of the event are protected by copyright. Duplication, distribution. The dissemination or other use of materials handed out or made available electronically - including extracts - is only permitted with the express written consent of the AirportAcademy.

The use of the Munich Airport/AirportAcademy word/figurative mark requires the express consent of the AirportAcademy.

The AirportAcademy will not make use of business and trade secrets that come to its knowledge during the performance of the services in any context other than performance of the services without authorisation.

The AirportAcademy is authorised to process and store the participant's personal data to the extent and for as long as this is necessary to process the contract. When processing data, the Academy fulfils all data protection requirements. Stored data will not be passed on to third parties. 

9 Place of fulfilment and jurisdiction

The law of the Federal Republic of Germany shall apply exclusively. The place of fulfilment of the mutual performance obligations is exclusively the premises of Munich Airport. The place of jurisdiction for each party in the event of a dispute arising from a contractual relationship is exclusively the local court district of Erding/regional court district of Landshut.
